Abstract

This study discusses the role of the Sikka District Land Office in overcoming the problem of absentee land ownership in Talibura Sub-district. Land is an important resource for development, but increasing absentee land ownership causes an imbalance in the distribution of land ownership. This impacts on the welfare of farmers and local communities. Using qualitative research methods, this study aims to analyze how the land office can prevent land ownership practices that are not in accordance with applicable regulations. In agrarian law, the regulation of absentee land is regulated in Law No. 5/1960 on the Basic Regulation of Agrarian Principles (UUPA). Articles in the UUPA, such as Article 10 which requires landowners to actively cultivate their land and Article 3 paragraph (1) of Government Regulation No. 224/1961 in conjunction with Article 1 of Government Regulation No. 41/1964 which requires landowners who do not live in the location to transfer their land rights, provide the legal basis for addressing this issue. Although there are clear provisions, the implementation is often not maximized, so further action is needed from the government. The results show that although the Sikka District Land Office has taken several steps such as inventorying and monitoring absentee land, there are still many cases of violations that occur. Several factors, such as the lack of public legal awareness and the suboptimal application of the law, hamper the enforcement of existing provisions. Therefore, administrative and legal curbs as well as the application of firmer sanctions are needed to overcome the problem of absentee land ownership, in order to create agrarian justice and community welfare in Sikka Regency
