Abstract

Indonesia is a state of law that guarantees equality before the law for all citizens as stipulated in Article 27 paragraph (1) of the 1945 Constitution. However, the reality still shows obstacles in law enforcement, as seen in the murder case of Astrid Manafe and Lael Maccabee in East Nusa Tenggara (NTT). This case is in the spotlight due to the slow resolution due to the repeated return of the case file by the prosecutor's office to the police (P19). This research uses empirical or socio-legal legal methods, with an approach to the dynamics of legal practice in the field. The data used includes primary and secondary legal materials, such as KUHAP, related regulations, and legal literature. The analysis was conducted deductively to identify obstacles in the preparation of the Minutes of Examination (BAP) and its threat to the legal process. The results showed that the unclear limit on the number of returns of case files, as well as the lack of coordination between investigators and prosecutors, hampered legal certainty. This condition risks reducing public confidence in the criminal justice system. Therefore, better synergy between law enforcement agencies is needed to ensure efficiency and fairness in the investigation and prosecution process
