Abstract

Persecution is an act of violence committed by a person against another person, both physically and psychologically, which can cause injury or even death. R. Soesilo in the book of the Criminal Code and his comments Complete Article by Article explains according to jurisprudence that persecution is an act that deliberately causes pain or injury or deliberately damages the health of another person (even causing death). The crime of persecution basically refers to the existence of losses that can be experienced by the victim. There are times when acts of persecution committed by criminal perpetrators can cause death for the victim. This will then become an important question in studying the existence of a penal enforcement system in Indonesia. Especially in looking at the provisions and legal processes that are being undertaken for perpetrators of criminal acts of persecution. In line with that, in these various complex problems, the analysis related to the existence of criminal cases has become a new means of learning in looking at the enforcement of the law in Indonesia
