Abstract

This research analyzes criminal acts of gambling with a focus on the Dato Hasan Sarabiti case, which is regulated in Article 303 of the Criminal Code. This study includes an evaluation of the investigation process, investigation, preparation of charges, and trial. The results of the analysis show that the elements of a gambling crime, such as betting activities, gambling tools, and the perpetrator's intention, have been fulfilled. The investigation process is carried out in accordance with Article 184 of the Criminal Procedure Code, by prioritizing legal evidence such as witness statements, suspect confessions and evidence. Apart from that, juridical and non-juridical considerations, including social and economic impacts, also influence the judge's decision in handing down a verdict. This study highlights the importance of a holistic approach in eradicating criminal gambling. This approach includes strict law enforcement, educating the public about the dangers of gambling, as well as strengthening regulations to prevent the spread of the negative impacts of gambling. With these steps, it is hoped that a safer social environment can be created, free from the influence of gambling.
