Abstract

PT. Bhanda Ghara Reksa is taking responsible for the safety of the recipient and delivery of commodity and the truth of reports submitted and regulates the use of unload and payload services. There are the limits of the responsibility of the unload and payload can be achieved if the implementation is supported by skilled of human resources and the use of adequate unload and payload equipment. The formulation of the problem in this study is how the responsibility of the loading and unloading company for the safety of goods in the implementation of the agreement between PT. Adhiguna Putera as a Customer with PT. Bhanda Ghara Reksa Logistics (Persero) Divre Kupang as its Vendor, What are the factors that are an obstacle in carrying out the responsibility of loading and unloading companies and how to overcome them in the implementation of loading and unloading. This research is an empirical juridical research using two methodologies, the first is the Interview method, namely by conducting direct interviews with company leaders and employees. The second method is observation or field observations in order to collect data from where loading and unloading activities take place. The results of this study indicate that the limits of the responsibility of the loading and unloading company are the achievement of smooth and safe loading and unloading of goods, the availability of equipment and supplies for loading and unloading activities. Shortages and losses caused by the company due to negligence on the part of the company, the company must compensate for these losses according to the agreement made. The obstacles that arise during loading and unloading vary greatly, so coordination of the parties is needed in resolving the obstacles that arise and if a dispute occurs, it can be resolved by deliberation and consensus. Constraints faced in the loading and unloading process include weather factors, equipment factors, delays in land transportation (waiting trucks), loading conditions and safety factors. The company can maintain and even improve performance in handling the implementation of its responsibilities for damage/lack of cargo in the loading and unloading process.
