Abstract
This research is entitled "The dynamics of customary land conflicts between indigenous communities and the government" a case study of Kalang Maghit land disputes in Gunung Village, Kota Komba sub-district, East Manggarai Regency. The aim of the research is to find out the history of the conflict and the conflict resolution process between the Kende tribal community who live in Tanah Kalang Maghit and the East Manggarai district government. This research was structured based on qualitative research methods with data collection techniques in the form of interviews and documentation. The results of the research show that the vertical conflict in fighting over Kalang Maghit land between the Kalang Maghit indigenous community (Kende Tribe) and the East Manggarai Regency Government began with the unilateral handover of Kalang Maghit land by the traditional alliance of Ritapada village, Gunung Village, Kota Komba District to the Regional Government of Manggarai Regency in 1982 for the Regional Government program, namely the Local Transmigration program and the second factor, namely the transition from the Local Transmigration program to the Self-Management program without the knowledge of the Kalang Maghit community. Efforts to resolve the conflict have been underway several times, both in dialogue between the two parties and the involvement of third parties in mediating this protracted conflict. Several inhibiting factors in efforts to resolve this land conflict are injustice in the negotiation process, lack of resources or capacity to manage the conflict, lack of trust between the Kalang Maghit indigenous community and the East Manggarai Regency Regional Government and disagreement over the claims made by each party. The suggestion for both parties so that conflict resolution can run well is to re-examine the documents related to the Kalang Maghit land claim between both parties and the resolution of this conflict must benefit both parties so that no party feels disadvantaged
