Abstract

This study analyzes the role of property ownership and control rights in resolving land disputes in Boneana Village, Kupang Barat Subdistrict, Kupang Regency. The research adopts a qualitative approach, employing data collection methods such as observation, interviews, and document analysis. The findings of the study reveal the significant role of property ownership and control rights in the resolution of land disputes in Boneana Village. Firstly, property ownership serves as the legal basis for determining land rights and becomes a reference point in the dispute resolution process. Clearly registered land ownership provides legal certainty to the rightful owners. Secondly, control rights play a crucial factor in determining the authorized parties involved in the revocation and acquisition of land for public purposes. Valid control rights, bound by applicable regulations, legitimize the responsible entities in the decision-making process. However, the study also identifies several challenges in resolving land disputes in Boneana Village. These include conflicts of interest between landowners and those seeking land for public purposes. Additionally, limited awareness among the community regarding the importance of land rights registration and limited access to legal assistance pose obstacles to effective land dispute resolution. Based on the research findings, it is recommended that local governments enhance the dissemination of information and legal education concerning property ownership and control rights to the community. Furthermore, improvements in procedures and mechanisms for resolving land disputes are necessary to ensure fairness and protect the interests of all parties involved. By doing so, the resolution of land disputes in Boneana Village can be conducted effectively and fairly in accordance with the principles of property ownership and control rights.
