Abstract

The Supreme Court (MA) decision regarding Article 28 Paragraph 2 which regulates freedom of association in Law Number 21 of 2000 has been the subject of in-depth debate and analysis in the context of freedom of opinion in Indonesia. Analysis of the Supreme Court's decision which has two points of view, namely those who agree and those who reject, provides a rich picture of legal interpretation related to legal policies relevant to freedom of association in this country. The Supreme Court's decision in favor emphasizes the protection of freedom of association as a constitutional right that must be guaranteed, while the decision that rejects it reflects legal considerations that highlight the limitations in exercising freedom of association in the public interest. These two points of view reflect the complexity of law enforcement and protection of human rights in Indonesia, and provide a basis for in-depth discussion about the strengths and limitations of Article 28 Paragraph 2 in the practice of national and state life. This synopsis provides an overview of the variations in interpretation and implications of the Supreme Court's decision on the issue of freedom of association in the context of law and society in Indonesia.
