Abstract

Criminal law is a type of suffering intentionally given by the state to a person or several people, as a response to behavior which according to criminal law rules is a prohibited act. Laws are created, grow and develop in society with the aim of regulating people's lives, both modern and traditional societies, in order to create order, tranquility, peace and prosperity. In conducting research the author refers to research methods, so that the research is more focused and planned . The research method that the author uses is a normative research method. This research uses a problem approach, a statutory approach (Statute-Approach) and a conceptual approach. Article 55 of the Criminal Code may not be something new for society in general, especially Indonesian society, because there have been many criminal cases that are motivated or related to the article. 55 of the Criminal Code. Even though there have been many criminal acts or cases under Article 55 of the Criminal Code, there are quite a few people who do not understand what cases fall under Article 55 of the Criminal Code. Based on the previous description and analysis, a conclusion can be drawn as an answer to the problem formulated above, namely, that the death penalty is still included in the Criminal Code and outside the Criminal Code for several reasons, namely considering that Indonesia's territory is very large and its population consists of various ethnic groups. and groups with different customs and traditions
