Abstract

Land rights are fundamental rights that mean a lot to society for one's dignity and freedom. On the other hand, it is the obligation of the state to guarantee legal certainty for the right to the land even though the right is still limited by the interests of others, the community, and even more so the state. In this case the recognition of land ownership is concretized by the issuance of a certificate of land title. A certificate is a letter of proof of land rights, an acknowledgement and affirmation from the state of individual or joint land tenure or a legal entity whose name is written in it and explaining the location, drawing, size and boundaries of the land parcel as contained in Article 19 paragraph (2) letter c of the UUPA. Land certificates are issued by the National Land Agency, but have defects in the part of ownership status that is more based on one owner who has authority or overlapping rights to control a piece of land either in part or in whole using the owners concerned who have the same letter or document indicating evidence. At the Kupang City BPN Office, there was a dispute over double certificates of land ownership rights which was resolved at the Kupang City BPN office, namely the problem of a plot of land covering an area of 17,880 m2. That the owner of the land with the initials A. N who controlled the object of the piece of land since 1942 is located in Tuak Merah, Oebufu Village, Kupang Tenggah District, Kupang Regency, East Nusa Tenggara Province. In the course of time, in 1983 there was another party who claimed that the land belonged to him (the S family in the name of M. S and A.S).
